Prosecutors say the "touching" statute only applies to strippers who "regularly appear" at the establishment. "I deeply apologize to my fans in Columbus".
Avenatti said it was "ridiculous" that Columbus Police forced Daniels on a perp walk for the cameras at Jackson Pike Correctional Facility and police could instead focus on Columbus's skyrocketing murder rate.
"During her performance, they asked her if they could place their face in between her breasts while she was performing on stage", he said. Daniels started performing at about 11:30 p.m. Wednesday, according to an affidavit filed in Franklin County Municipal Court.
The court documents also did not specify whether or not Clifford was taken into custody. The detectives witnessed her actions and approached the stage where Daniels proceeded to fondle an officer's buttocks and breasts while placing each of their faces between her breasts. In addition to touching Prather's breasts and butt during her act, Daniels allegedly placed the officer's face on her breasts.
Stormy was released early on Thursday morning on a $6,000 bond.
Her lawyer called the arrest "a setup" and "politically motivated".
Daniels, 39, filed a lawsuit against Trump and his former personal attorney, Michael Cohen, late previous year, seeking to invalidate a nondisclosure agreement that she says barred her from speaking about the alleged affair.

Those include Viagra, cholesterol drug Lipitor and arthritis treatment Xeljanz, according to Wells Fargo. Trump rolled out a blueprint in May on how his administration planned to lower drug prices.
"I am pleased to report that the charges against my client @stormydaniels have been dismissed in their entirety", Avenatti said on Twitter, thanking prosecutors for their "professionalism".
"It was an absurd use of law enforcement resources", Avenatti said.
Mr Avenatti wrote: "This was a setup & politically motivated. It reeks of desperation", his tweet said. She was charged with three misdemeanor sex-offenses.
"Since last fall, Columbus Police were made aware of illegal activity through various adult entertainment clubs throughout the city".
Avenatti confirmed to Fox News that his client was arrested just after midnight Thursday.
He says he's confident that she'll be cleared of all charges. The payment might have violated campaign finance laws.
